TERMS AND
CONDITIONS
AppConn.
Effective: August 29, 2026
I. FORMATION AND ACCEPTANCE
These Terms and Conditions constitute a binding legal
agreement between AppConn., organized under the laws of the United States
(referred to throughout as "Company," "we," "us,"
or "our"), and each person or entity (referred to as
"Customer," "client," "you," or "your")
who purchases, accesses, or utilizes services available through the website
located at https://appconn.io/.
Your act of completing any registration process, submitting
payment information, or accessing any portion of our services constitutes
unconditional acceptance of these Terms. Should you disagree with any provision
contained herein, you must refrain from using the services entirely. There
exists no partial acceptance; agreement is total or it does not exist at all.
We retain the right to modify these Terms at any time.
Changes become effective upon publication to the website. Your continued use
after such publication operates as acceptance of the revised terms. The burden
rests upon you to review these Terms periodically. We have no obligation to
provide individualized notice of amendments, though we may elect to do so as a
courtesy.
II. DEFINITIONS AND SERVICE SCOPE
The Company provides web hosting services and domain name
registration services (collectively, "Services"). Web hosting
encompasses the provision of server infrastructure, storage allocation,
bandwidth, email functionality, and related technical capabilities necessary to
maintain an internet-accessible website. Domain registration involves
facilitating the registration of internet domain names through accredited
registrars operating under the authority of the Internet Corporation for
Assigned Names and Numbers, commonly known as ICANN.
Hosting plans may be purchased on monthly, annual, or
multi-year terms as the Customer selects at the time of purchase. Each plan
includes specified resource allocations detailed in the service description
applicable to the selected plan. Domain names require registration for no less
than one year initially, though multi-year registrations are available and may
be advantageous from both cost and administrative perspectives.
Services are delivered on an "as is" and "as
available" basis. While we employ commercially reasonable efforts to
maintain operational continuity, we make no guarantee of uninterrupted service.
Interruptions may occur due to maintenance activities (whether scheduled or emergency
in nature), equipment failures, force majeure events, or other circumstances
beyond our reasonable control. When practicable, we will provide advance notice
of scheduled maintenance, but such notice is not required and its absence does
not constitute a breach.
III. ELIGIBILITY AND CUSTOMER OBLIGATIONS
Customers must possess legal capacity to enter binding
contracts under applicable law. If you are entering this Agreement on behalf of
a corporation, partnership, or other entity, you represent and warrant that you
hold the authority to bind that entity to these Terms. Unauthorized
representations of authority may subject you to personal liability for
obligations incurred.
You agree to provide accurate, current, and complete
information during registration and throughout your use of the Services. This
obligation extends particularly to domain name registration, where ICANN
policies mandate accuracy of registrant contact information. False or
misleading information may result in suspension or cancellation of services
without refund. Furthermore, providing false WHOIS information violates federal
law in certain circumstances and may expose you to civil or criminal liability
under 18 U.S.C. § 1001 or other applicable statutes.
You bear sole responsibility for maintaining the
confidentiality of your account credentials. Any activity occurring under your
account is attributed to you. If you discover or suspect unauthorized access,
you must notify us immediately at support@appconn.io.
Delayed notification may limit our ability to mitigate damage and may affect
your rights under this Agreement.
IV. ACCEPTABLE USE
Your use of the Services must comply with all applicable
federal, state, and local laws and regulations. The following activities are
expressly prohibited:
Transmission of unsolicited commercial email, commonly
termed spam, in violation of the CAN-SPAM Act, 15 U.S.C. § 7701 et seq. This
prohibition extends to bulk emailing to recipients who have not provided prior
express consent or who have exercised their right to opt out of future
communications. Violations of this prohibition result in immediate termination
without refund and may subject you to statutory damages ranging from $250 to
$16,000 per violation as provided in the Act.
Infringement of intellectual property rights, including
copyrights protected under 17 U.S.C. § 101 et seq., trademarks protected under
15 U.S.C. § 1051 et seq., or patents, trade secrets, or other proprietary
rights. We respond to properly submitted notices under the Digital Millennium
Copyright Act and maintain a repeat infringer policy as required by 17 U.S.C. §
512.
Distribution of malicious software, including viruses,
worms, trojans, ransomware, spyware, or other code designed to damage, disrupt,
or gain unauthorized access to computer systems. Such activity may violate the
Computer Fraud and Abuse Act, 18 U.S.C. § 1030, and subjects you to federal
prosecution in addition to civil liability.
Hosting or distributing content that violates federal
criminal statutes, including but not limited to obscenity as defined in 18
U.S.C. § 1460 et seq., child sexual abuse material as prohibited by 18 U.S.C. §
2251 et seq., or content that incites imminent lawless action as described in
Brandenburg v. Ohio, 395 U.S. 444 (1969).
Port scanning, network probing, or other activities designed
to identify vulnerabilities in our infrastructure or that of other users. Such
conduct violates the reasonable use principles underlying shared hosting
environments and may degrade service quality for other customers.
Operating services that place excessive load on shared
resources, including but not limited to cryptocurrency mining, proxy services,
or applications that consume disproportionate CPU cycles, memory, or bandwidth
relative to typical usage patterns. We reserve the right to define
"excessive" based on our operational experience and to throttle or
suspend accounts that adversely affect infrastructure stability.
Use of the Services to violate export control regulations,
including the International Traffic in Arms Regulations (ITAR), 22 C.F.R. §§
120-130, or the Export Administration Regulations (EAR), 15 C.F.R. §§ 730-774.
If your activities involve the export of controlled technology or software, you
bear independent responsibility for obtaining required licenses.
Upon discovering any violation of this Acceptable Use
Policy, we may suspend or terminate services immediately without prior notice.
This right exists independently of any refund provisions described elsewhere in
this Agreement. We may also preserve and disclose account information to law
enforcement as required by legal process or as we determine necessary to
protect our rights, property, or the safety of our users or the public.
V. PAYMENT TERMS
Prices for Services are stated in United States Dollars and
are set forth on the website at the time of purchase. We may change prices at
any time, though price changes do not affect services already purchased for a
prepaid term. Renewal prices may differ from initial purchase prices. You will
be notified of the renewal price prior to processing renewal charges.
Payment is due at the time of purchase. We accept major
credit cards, debit cards, and such other payment methods as we may designate
from time to time. By providing payment information, you authorize us to charge
all fees associated with your selected services, including initial charges,
renewal charges, and charges for additional services you request.
Services purchased on a subscription basis renew
automatically at the conclusion of each service period unless you cancel prior
to the renewal date. Automatic renewal prevents inadvertent service lapses that
could result in website downtime or loss of domain registration. To cancel automatic
renewal, you must submit written notice to support@appconn.io no
later than five business days before the scheduled renewal date. Cancellation
requests received within five business days of renewal may not be processed in
time to prevent the renewal charge.
If a payment method fails or if you fail to pay amounts due,
we may suspend services immediately. Suspension continues until all outstanding
amounts are paid in full. If payment default continues for thirty days
following written notice, we may terminate your account and pursue collection
through available legal means. You will be responsible for collection costs,
including reasonable attorneys' fees actually incurred.
VI. REFUNDS AND MONEY-BACK GUARANTEE
The Company provides a thirty-day money-back guarantee
applicable to web hosting services. This guarantee permits you to request a
full refund of hosting fees paid if you are dissatisfied with the Services for
any reason within thirty calendar days from the date of initial purchase.
To request a refund under this guarantee, you must submit a
written request to support@appconn.io within
the thirty-day period. The request should include your account information, the
specific services for which you seek a refund, and information regarding your
original payment method. We will process approved refund requests within ten
business days following receipt of a complete request.
Refunds are issued to the original payment method used for
purchase. If the original payment method is no longer valid or accessible, we
will work with you to identify an alternative method, which may include
electronic transfer to a verified bank account or issuance of a company check.
Several categories of charges are expressly excluded from
the thirty-day money-back guarantee and are non-refundable under any
circumstances. These exclusions are necessary because of the immediate value
conveyed upon purchase or because we incur non-recoverable costs in providing
these services.
Domain name registration fees are non-refundable. When you
register a domain name, that name is immediately registered with the applicable
registry and removed from availability for others to register. The registry
charges we pay to secure your domain registration are non-recoverable. This
applies to new registrations, renewal registrations, and domain transfers. The
non-refundable nature of domain registrations is consistent with industry practice
and is required by registry policies incorporated into our agreements with
upstream providers.
Setup fees, migration fees, and similar one-time charges are
non-refundable. These fees compensate us for time and resources expended in
configuring your account, transferring data from another provider, or
performing other services specific to your account initialization. Once
performed, these services cannot be "returned."
Administrative fees for expedited services, rush processing,
or specialized technical assistance beyond the scope of standard support are
non-refundable. These fees reflect priority allocation of our staff resources
and are earned when the service is performed.
Third-party services and add-on products, including SSL
certificates, dedicated IP addresses, security services, backup services, or
products provided by vendors other than the Company, are non-refundable. We
typically pay these vendors at the time of purchase, and their terms prohibit
refunds.
To be eligible for a refund under the thirty-day money-back
guarantee, you must not have violated any provision of this Agreement,
including the Acceptable Use Policy. Accounts terminated for violations are not
eligible for refunds under any circumstances. This limitation is necessary to
prevent customers from using services for prohibited purposes and then seeking
refunds before we discover the violations.
The thirty-day money-back guarantee applies only to
first-time purchases of hosting services. If you previously maintained an
account with us and canceled or received a refund, you are not eligible for
another refund under the guarantee. This prevents abuse through repeated
purchase and cancellation cycles. However, this limitation does not apply if
you are purchasing a different hosting product or if more than one year has
elapsed since your prior account termination.
Refunds are calculated based solely on hosting service fees.
Taxes, payment processing fees, or other charges imposed by third parties are
not refundable. If you purchased multiple services in a single transaction,
only the portion attributable to eligible hosting services will be refunded.
The provisions of this Section should not be construed as
warranties of performance, fitness for a particular purpose, or
merchantability. To the extent the Magnuson-Moss Warranty Act, 15 U.S.C. §§
2301-2312, applies to any aspect of the Services (which applicability we
dispute given that the Services constitute services rather than consumer
products), any warranty provided would be classified as a "limited
warranty" rather than a "full warranty" as those terms are
defined in 15 U.S.C. § 2303. The Company does not provide written warranties as
that term is defined in 15 U.S.C. § 2301(6), and the refund policy described in
this Section constitutes a satisfaction guarantee rather than a warranty of
product performance.
Nothing in this Section should be interpreted as creating
liability for consequential damages, incidental damages, or indirect damages of
any nature. The refund of hosting fees represents the entirety of our liability
for dissatisfaction with Services, except where applicable law prohibits such
limitations.
VII. DOMAIN NAME REGISTRATION SPECIFIC TERMS
Domain name registration subjects you to policies adopted by
ICANN and by the specific registry operator for the top-level domain you
register. These policies are incorporated by reference and are binding upon
you. Key policies include the Uniform Domain Name Dispute Resolution Policy
(UDRP), which establishes procedures for resolving disputes when a domain name
allegedly infringes trademark rights or was registered in bad faith.
You represent and warrant that registration of your chosen
domain name does not infringe any third party's intellectual property rights
and that you are registering the domain name for lawful purposes. You agree not
to register domain names for the purpose of selling them to trademark holders
(commonly termed "cybersquatting"), which may violate the
Anticybersquatting Consumer Protection Act, 15 U.S.C. § 1125(d).
You acknowledge that domain name registration does not
confer trademark rights. Trademark rights arise from use of a mark in commerce
or from registration with the United States Patent and Trademark Office, not
from domain name registration alone. If another party holds superior trademark
rights, you may be compelled to transfer the domain name through UDRP
proceedings or court action.
Domain names that are not renewed prior to expiration enter
a grace period during which renewal remains possible, followed by a redemption
period during which recovery requires payment of additional fees. If a domain
name is not recovered during the redemption period, it is released and becomes
available for registration by others. We will send renewal reminders to the
email address associated with your account, but you bear ultimate
responsibility for timely renewal. Email deliverability issues do not excuse
failure to renew.
VIII. INTELLECTUAL PROPERTY
The website, Services, software, and all related content
(including text, graphics, logos, images, and code) are owned by the Company or
our licensors and are protected by copyright, trademark, and other intellectual
property laws. Your use of the Services does not transfer any ownership rights
to you.
You are granted a limited, non-exclusive, non-transferable,
revocable license to access and use the Services for their intended purpose.
This license does not permit resale, redistribution, modification, reverse
engineering, or creation of derivative works. Any unauthorized use terminates
the license immediately.
Content you upload to or create through the Services remains
your property. However, you grant us a limited license to store, transmit, and
display that content as necessary to provide the Services. This license
continues for so long as you maintain an account with us and terminates upon
account closure, subject to reasonable time for data deletion from backup
systems.
IX. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE
SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER
EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Services will meet your specific
requirements, that operation will be uninterrupted or error-free, that defects
will be corrected, or that the Services or servers are free of viruses or other
harmful components.
Some jurisdictions do not permit disclaimer of implied
warranties, in which case the foregoing disclaimer applies only to the extent
permitted by law.
X. LIMITATION OF LIABILITY
IN NO EVENT SHALL THE COMPANY BE LIABLE FOR INDIRECT,
INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT
LIMITED TO LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL,
REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF
SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR
RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US DURING THE
THREE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.
These limitations reflect the allocation of risk between the
parties and are reflected in the pricing of the Services. They apply to the
fullest extent permitted by applicable law.
XI. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the
Company, its officers, directors, employees, agents, and affiliates from all
claims, liabilities, damages, losses, costs, and expenses (including reasonable
attorneys' fees) arising from: (a) your use of the Services; (b) your violation
of these Terms; (c) your violation of any third-party rights; (d) content you
post or transmit through the Services; or (e) any breach of your
representations and warranties.
We reserve the right to assume exclusive defense of any
matter subject to indemnification, in which case you agree to cooperate in
asserting available defenses.
XII. TERM AND TERMINATION
This Agreement continues until terminated by either party.
You may terminate by ceasing use of the Services and providing written notice
to support@appconn.io. Termination by you does
not entitle you to a refund except as provided in Section VI.
We may terminate or suspend your access immediately, without
prior notice, for any violation of these Terms, for failure to pay amounts due,
or for any conduct we believe creates liability for us or harms other
customers.
Upon termination, all licenses granted to you terminate
immediately. Provisions that by their nature should survive termination will
survive, including Sections VI (to the extent it addresses limitations), VIII,
IX, X, XI, and XIII.
XIII. DISPUTE RESOLUTION
This Agreement is governed by the laws of the United States
and the state in which the Company maintains its principal place of business,
without regard to conflict of law principles. You consent to the exclusive
jurisdiction of federal and state courts located in that state.
Before filing any legal action, you agree to attempt
resolution through good-faith negotiation for a period of thirty days following
written notice describing the dispute.
Any claim arising from these Terms or the Services must be
filed within one year after the claim arose. Otherwise, it is permanently
barred.
XIV. GENERAL PROVISIONS
This Agreement constitutes the entire agreement between you
and the Company regarding the Services and supersedes all prior agreements and
understandings.
If any provision is found unenforceable, that provision will
be modified to the minimum extent necessary to make it enforceable, or if
modification is not possible, it will be severed and the remaining provisions
will remain in effect.
Our failure to enforce any provision does not waive our right
to enforce it later or to enforce other provisions.
You may not assign this Agreement without our prior written
consent. We may assign this Agreement without restriction.
All notices must be in writing and sent to support@appconn.io for
the Company or to the email address associated with your account for you.
Questions regarding this Agreement should be directed
to support@appconn.io.
